香港商標註冊申請條件
辦理香港商標註冊申請所需材料
以法人申請，附《營業執照》或有效登記證明複印件1份和公司名稱地址中英文相對應的翻譯；以自然人申請附個人身份證複印件1份；
清晰商標圖樣1份；
填寫申請表1份，申請表必須由申請人簽署或由代理人簽署;
列出尋求註冊的商品或者服務，指出商標類別（香港的商標可以全類保護），可從本網站，商標分類表中查詢。
商標註冊委託書，申請人必須在該委託書上籤字蓋章
香港商標註冊查詢
任何人都可隨時使用香港政府知識產權署的免費搜尋網頁。搜尋是否有相同或相似的註冊香港商標和在先申請。
如果要委託本公司全面地和專業地搜尋，則每搜尋1商標在1個國際分類的收費是人民幣500元。 所需時間是1個工作日。搜尋報告是以書面作出, 內容包括確實在香港有無相同的註冊商標和在先申請, 列出所搜尋出的近似的商標, 並提供對近似商標是否構成，混淆相似，作出本所的專業書面意見。
如果客戶所要申請的商標有文字也有圖案，本公司的搜尋將無加費地包括那文字和圖案兩部份。若是本公司書面意見作出正面的申請建議，而申請後出現審批員因有混淆相似的商標存在而作出的反對, 本公司將退還所有的申請收費。
商標註冊處在審查有關申請前，會先詳細檢視申請表格及所有附屬檔案，以查看錶格內須填寫的部分是否已經填妥、有關資料是否正確、所需資料是否不全。如一切妥當，申請程式會進入下一階段（實質審查階段）。
香港商標註冊實質審查
完成檢查申請的不足之處並確定所有資料備妥後，商標註冊處會翻查商標記錄，以確定在相同或類似的貨品或服務，是否有其他商戶已經註冊或申請註冊相同或類似的商標。商標註冊處會同時查核有關商標是否符合《商標條例》所訂的註冊規定。
如審核通過，申請程式將進入下一階段（登憲公告階段）。
登憲公告
商標註冊處核准申請後，便會在香港智慧財產權公報公告，為期三個月，如無人提出異議，該商標就可以成功註冊了。
註冊
商標註冊申請被核准後，便會把該商標的詳細資訊記入註冊紀錄冊，並向申請人發出註冊證明書。此外，商標註冊處處長會在香港智慧財產權公報中公布有關的註冊公告。註冊日期會追溯至提交申請當日，換言之，作為註冊商標擁有人的權利，應由提交申請當日起計。
申請商標費用
申請商標的收費為第一個國際分類為￥2380。 每加入一個分類需另外加收￥1800。付予香港政府的申請費以及查冊費都已包括在內，公告、註冊和領證都無另收費。除非申請受到審批員的反對，需要作出修改，遭受異議或者出現其它複雜情況，否則無其它的收費。
註冊香港商標辦理時間
提供註冊商標之圖案及類別，進行初步查冊；
填寫商標註冊申請書，提交商標註冊的正式圖樣及商標申請者資料；
正式進入商標註冊流程（約4——6個月）：
政府查冊（一周）——香港知識產權署商標受理之回執（2周）——政府內部審核——排版印刷——憲報公告（3個月）——正式審批完成——領取商標證書。（有效期限10年，可續期）
香港商標註冊辦理流程
1、向香港知識產權署提出申請；
2、香港知識產權署受理；
3、審查；
4、刊登公告，三個月的異議期；若被提異議（香港稱為反對），申請人須對此作出答辯（香港稱為反陳述），否則申請將被撤回；
5、核准註冊，領取商標註冊證。

注意事項
註冊香港商標的保護措施
註冊香港商標的有效期為7年，之後可續期14年，續展次數不限，香港商標註冊有效期以申請日開始計算。在A部或在B部註冊的商標法律地位有所不同。在A部註冊的商標專用權有較大保障。A部的註冊商標註冊期滿7年或視為永久有效；在 B部註冊的商標則不享有相同的法律保障，在註冊期滿後，其註冊效力仍可能受到質疑。在遇到商標侵權時，法院易於作出對A部註冊商標侵權的認定，而對B部註冊的商標所有人的指控，被告人可有較多的辯護理由，法院也可能不予頒髮禁止令。
商標設計要注意以下問題
獨創性，即商標的設計要有新意;商標的名稱應避免與商品的功能聯在一起;商標的設計要突出主題，合理布局。
香港商標註冊注意事項
注意事項:
1、為了使該商標能順利註冊成功，首先考慮該商標是否具顯著特性，最好自己設計與眾不同的文字及圖形創新的商標。
2、不可抄襲別人或跟別人類似的商標到頭來浪費自己的時間和金錢.
3、註冊此商標前有否在其他國家己註冊，如有請提供副本，半年之內有優先權。
香港商標維權
商標反對
在香港，任何人均可對公告的商標申請提出反對。反對人須在商標公布之日起3個月內提交反對通知，並在指定時限內提供證據。如反對人在商標註冊處安排的聆訊中敗訴，或需支付另一方訟費。
侵權訴訟
註冊商標的擁有人可就該商標遭侵犯而進行訴訟。在反侵犯法律程式中，註冊商標的擁有人可獲得所有屬損害賠償、強制令、交出所得利潤形式或其他形式的濟助。
