中華人民共和國民用航空器權利登記條例實施辦法

第一條　為便利民用航空器權利人辦理民用航空器權利登記事項，根據《中華人民共和國民用航空器權利登記條例》（以下簡稱《條例》），制定本辦法。

第二條　中國民用航空總局民用航空器權利登記職能部門（以下稱登記部門），負責辦理民用航空器權利登記的具體事宜。

第三條　登記部門設立和保管民用航空器權利登記簿，統一記載民用航空器權利登記事項。

第四條　民用航空器權利人認為需要進行權利登記的，可申請辦理民用航空器權利登記。

第五條　在申請辦理權利登記時，申請人應當向登記部門提交有關申請書的原件以及《條例》和本辦法規定的相應檔案的原件。提供相應檔案原件確有困難的，可以提供經核對無誤的複印件。相應檔案原件和經核對無誤的複印件均為有效檔案。不能及時提供有效檔案的，可以先行提供複印件，但是，應當在登記部門收到有關權利登記申請書原件之日起10個工作日內向登記部門提交有效檔案。在收齊全部有效檔案之日起7個工作日內，登記部門依照《條例》規定對申請的權利登記事項完成審查，並頒發相應的民用航空器權利登記證書，對經審查不符合《條例》規定的，書面通知申請人。申請人未能在上述10個工作日內提交有效檔案的，有關權利登記申請人應當重新提出申請。

本辦法所稱原件，是指檔案原件的正本或者副本。

本辦法所稱經核對無誤的複印件，是指符合下列條件之一的複印件：

（一）涉及有關機關出具的檔案的，經該機關核對並簽章；

（二）涉及交易檔案的，經交易各方當事人簽章；

（三）依法公證或者經中華人民共和國使領館認證的檔案複印件；

（四）經與原件核對無誤並簽注的複印件。

第六條　登記部門在接收申請人提供的有關檔案時，應當向其出具收件清單，並註明檔案接收日期和時間。

第七條　在申請辦理權利登記時，申請人應當提供下列證明其合法身份的檔案：

（一）申請人是個人的，其有效身份證明；

（二）申請人為企業法人的，工商登記機關頒發的企業法人營業執照；

（三）申請人為其他組織的，有關登記、註冊機關頒發的登記、註冊檔案；

（四）與上述檔案等效的身份證明檔案。

第八條　委託他人辦理權利登記或者簽署有關檔案的，應當向登記部門提交合法申請人的授權委託書或者其他授權證明檔案以及代辦人的符合前條規定的合法身份證明檔案。

同一項交易或者事件產生共同權利的，應當由一個權利代表人向登記部門辦理權利登記事項。

第九條　民用航空器權利登記申請人在辦理民用航空器權利登記時，應當根據具體情況分別填寫符合本辦法附屬檔案規定格式的以下權利登記申請書：

（一）《民用航空器所有權登記申請書》；

（二）《民用航空器占有權登記申請書》；

（三）《民用航空器抵押權登記申請書》；

（四）《民用航空器優先權登記申請書》。

第十條　《條例》第五條第（一）項所稱民用航空器國籍登記證書，是指中華人民共和國民用航空器國籍登記證書。

第十一條　《條例》第六條第（一）項所稱民用航空器國籍登記證書，包括中華人民共和國民用航空器國籍登記證書和外國民用航空器國籍登記證書。

《條例》第六條第（三）項所稱租賃契約，不包括出租人提供機組人員的租賃契約。

第十二條　《條例》第七條第（一）項所稱民用航空器國籍登記證書，包括中華人民共和國民用航空器國籍登記證書和外國民用航空器國籍登記證書。

第十三條　對中華人民共和國國籍或者外國國籍民用航空器具有優先權的，均可以向登記部門申請辦理優先權登記。

第十四條　登記部門對民用航空器權利人的權利登記申請審查合格後，應當根據申請向權利人分別頒發以下相應的權利登記證書：

（一）《民用航空器所有權登記證書》；

（二）《民用航空器占有權登記證書》；

（三）《民用航空器抵押權登記證書》；

（四）《民用航空器優先權登記證書》。

《民用航空器抵押權登記證書》只對民用航空器抵押權人頒發。

第十五條《條例》第十條第（六）項所稱民用航空器價值，是指設定權利時的民用航空器價值。主要技術數據是指民用航空器型號、出廠序號和設定權利時的技術狀況。

第十六條　民用航空器權利登記事項發生變更時，民用航空器權利人應當持有關的民用航空器權利登記證書以及變更證明檔案，向登記部門辦理權利變更登記，並應當根據具體情況分別填寫符合本辦法附屬檔案規定格式的以下權利登記變更申請書：

（一）《民用航空器所有權登記變更申請書》；

（二）《民用航空器占有權登記變更申請書》；

（三）《民用航空器抵押權登記變更申請書》；

（四）《民用航空器優先權登記變更申請書》。

第十七條　民用航空器權利人的權利變更登記申請經登記部門依法審查合格後，由登記部門在有關權利登記證書上和民用航空器權利登記簿上註明變更事項，不頒發新的權利登記證書。

第十八條　民用航空器權利人依照《條例》規定辦理註銷登記時，應當持有關的民用航空器權利登記證書以及證明檔案，向登記部門辦理權利註銷登記，並應當根據具體情況分別填寫符合本辦法附屬檔案規定格式的以下權利登記註銷申請書：

（一）《民用航空器所有權登記註銷申請書》；

（二）《民用航空器占有權登記註銷申請書》；

（三）《民用航空器抵押權登記註銷申請書》；

（四）《民用航空器優先權登記註銷申請書》。

第十九條　民用航空器權利人的權利登記註銷申請經登記部門依法審查合格後，由登記部門收回並註銷其有關權利登記證書，並根據《條例》第十八條規定向民用航空器權利人分別頒發以下相應的權利登記註銷證書：

（一）《民用航空器所有權登記註銷證書》；

（二）《民用航空器占有權登記註銷證書》；

（三）《民用航空器抵押權登記註銷證書》；

（四）《民用航空器優先權登記註銷證書》。

第二十條　有關權利登記的生效日期和時間為登記部門收到有關權利登記申請書原件的日期和時間。但是，收到有關權利登記申請書原件的日期和時間先於設定權利的日期和時間的，應當以設定權利的日期和時間為權利登記的生效日期和時間。變更或者註銷權利登記時同樣適用上述規定。

第二十一條　民用航空器權利的利害關係人對民用航空器權利登記持有異議，或者認為民用航空器權利人應當辦理變更登記或者註銷登記而未辦理的，可以憑人民法院的生效判決、裁定或者仲裁機構的生效裁決，向登記部門辦理有關權利登記、變更登記或者註銷登記。該判決、裁定或者裁決是由外國法院或者仲裁機構作出的，應當依法先經中華人民共和國的人民法院確認。此種登記的其他有關事項，分別適用《條例》和本辦法中的有關規定。

第二十二條　根據《條例》頒發的民用航空器權利登記證書，在被依法註銷前或者權利期限屆滿前有效。

第二十三條　民用航空器權利登記簿內所記載的事項，可以供公眾查詢、複製或者摘錄。

由申請人提供的申請書及各項檔案，登記部門應當妥善保管。對於申請人聲明涉及商業秘密的事項，登記部門不得向他人泄露。

第二十四條　申請人辦理民用航空器權利登記，公眾查詢、複製或者摘錄民用航空器權利登記事項，均應當繳納費用，收費標準和管理辦法另行制定。

第二十五條　本辦法所附各申請表格複印有效，用紙規格為182毫米×257毫米。

第二十六條　本辦法自1999年11月1日起施行。

本辦法施行後，登記部門辦理在《條例》施行之日起（含當日）設定的民用航空器權利；在《條例》施行之日前設定的民用航空器權利，可自2000年11月1日起補辦登記手續。
